Results vary depending on multiple external factors including market conditions, client cooperation, competition, platform algorithms, advertising budgets, audience behavior, and third-party platform policies.

Any examples, case studies, projections, or testimonials displayed on the Website are for informational purposes only and should not be interpreted as guarantees of future performance.

5. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You agree NOT to:

Delays caused by the client, including delayed communication, missing materials, or failure to provide approvals, may affect delivery timelines and project completion dates.

7. Accounts & Security

If any portion of the Services requires account registration, you agree to:

  • Provide accurate and current information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access or suspected security breach

We are not responsible for losses resulting from unauthorized use of your account caused by your failure to secure login credentials.

8. Revisions & Scope Changes

Unless otherwise stated in a written agreement, all projects include only reasonable revisions within the originally agreed project scope.

Requests that exceed the agreed scope, excessive revision requests, major redesigns, additional deliverables, or new feature requests may require additional billing and revised timelines.

Elevated Hub Digital reserves the right to determine whether a request falls outside the original scope of work.

9. Delivery Timelines

Any estimated delivery dates or timelines provided by Elevated Hub Digital are estimates only.

Delivery schedules may be affected by:

  • Project complexity
  • Revision requests
  • Client responsiveness
  • Technical issues
  • Third-party platform delays
  • Force majeure events

We are not liable for delays caused by factors outside our reasonable control.

10. Intellectual Property Rights

All Website content, graphics, logos, text, software, systems, automation workflows, templates, branding assets, and design elements are owned by or licensed to Elevated Hub Digital and are protected by intellectual property laws.

You may NOT:

Client Deliverables

Unless otherwise agreed in writing, final approved deliverables become the client’s property only after full payment has been received.

Elevated Hub Digital retains the right to display completed work in portfolios, case studies, social media, advertising materials, and promotional content unless otherwise agreed in writing.

11. User-Generated Content

If you upload, submit, or provide content to the Website or Services, you represent and warrant that:

  • You own the content or possess the necessary rights and permissions
  • The content does not violate any law or third-party rights
  • The content does not contain malicious or harmful material

By submitting content, you grant Elevated Hub Digital a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute the content as necessary to provide the Services.

Clients acknowledge that AI-generated outputs and automation systems may occasionally produce inaccuracies, interruptions, delays, or unexpected behavior.

The Services may rely on or integrate with third-party platforms including, but not limited to:

  • Meta / Facebook
  • Instagram
  • TikTok
  • YouTube
  • Google
  • Stripe
  • Twilio
  • OpenAI
  • Zapier
  • External hosting providers

Elevated Hub Digital is not responsible for:

  • Third-party outages or downtime
  • Platform policy changes
  • Account suspensions or bans
  • Payment processor issues
  • API failures or limitations
  • Changes in third-party pricing or functionality
  • Advertising account restrictions
  • Losses caused by third-party providers

Use of third-party platforms is subject to their own terms and policies.

14. Payments, Billing & Refunds

By purchasing services from Elevated Hub Digital, you agree to the following:

Chargebacks & Payment Disputes

Clients agree to contact Elevated Hub Digital before initiating any chargeback or payment dispute.

Fraudulent chargebacks or payment disputes may result in:

  • Immediate suspension of services
  • Termination of contracts
  • Collections or recovery actions
  • Legal claims where applicable

15. Confidentiality

Both parties agree to maintain the confidentiality of non-public business information shared during the course of a project.

Confidential information may include:

  • Login credentials
  • Marketing strategies
  • Internal business information
  • Customer information
  • Financial information
  • Proprietary systems or workflows

Neither party may disclose confidential information to unauthorized third parties without prior written consent unless required by law.
